1. ACCEPTANCE OF TERMS AND CONDITIONS

The Web site PanduCermat.org.my is owned and operated by the Ministry of Transport Malaysia. Access of and use of this Web site is provided by the Ministry of Transport Malaysia subject to the following terms:

By using PanduCermat.org.my you agree to be legally bound by these terms, which shall take effect immediately on your first use of PanduCermat.org.my. If you do not agree with these terms and conditions, please do not register to use our services, forum, message boards or interactive sections. Failure to comply with any of these terms and conditions may result in loss of privilege to use this service.
By using our Web site, you agree to be bound by, and to comply with, these terms and conditions and any other rules or guidelines which we may implement. The Ministry of Transport Malaysia reserves the right to update these terms and conditions at any time without notice to you. You may review the most current version of the terms of use by clicking the hypertext link located at the bottom of our Web pages.

2. CONDITIONS AND RESTRICTIONS ON USE

If you fail to comply with the terms of use, or if you engage in any of the following activities, the Ministry of Transport Malaysia may terminate your use of the Web site:

Using the Web site for any unlawful purpose;

Using the Web site for any purpose prohibited by the terms and conditions;

Engaging in any conduct that the Ministry of Transport Malaysia, in its sole discretion, believes is or may be harmful to another user or to any other party, directly or indirectly;

Violating any foreign, federal, state or local law or regulation;

Using the Web site in a manner that could impair, disable, overburden or damage any Ministry of Transport Malaysia server, or the network(s) connected to any Ministry of Transport Malaysia server, or interfere with any other party’s use and enjoyment of the Web site;

Attempting to gain unauthorized access to the Web site, other accounts, computer systems or networks connected to any Ministry of Transport Malaysia server or to the Web site, through hacking, password mining or any other means. In addition, Ministry of Transport Malaysia may terminate any user’s access for any reason or no reason at all in its sole discretion, with or without prior notice.

3. REGISTRATION

Certain sections of the Web site may require you to register. You will provide us with current, complete and accurate information as prompted by the applicable registration form. You agree to update this data when necessary to keep it current and accurate. You will be solely responsible for choosing and maintaining in confidence your password and user name. Ministry of Transport Malaysia will not be responsible should someone else use your password or account.

4. USE OF WWW.PANDUCERMAT.ORG.MY

The Web site and its services are for your personal use, only, except where otherwise expressly provided. You agree to use the Web site only to post, send and receive messages and material that are proper and, when applicable, related to the particular service. As examples of improper use, you agree not to:

Harass, stalk, defame, abuse, threaten or otherwise violate the legal rights (such as rights of privacy and publicity) of others.
Post, upload or disseminate any obscene, indecent, profane, defamatory or other inappropriate or illegal material.
Use the Web site and its services in connection with surveys, contests, raffles, games, “pyramid schemes,” chain letters, junk email, spamming or any duplicative or unsolicited messages.
Collect or store personally identifying information about other users for commercial or unlawful purposes.
Make any sexual request on behalf of or to a minor or harm minors in any other way.
Impersonate anyone.
Employ misleading addresses or false information.
Upload, or otherwise make available, files that contain images, photographs, software or other material protected by intellectual property laws, including without limitation copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary approvals.
Use any material or information, including without limitation images or photographs, which are made available through the Web site in any manner that infringes anyone’s proprietary right.
Upload, post, e-mail or otherwise transmit files that contain so-called viruses, Trojan horses, worms, time bombs, trap doors, corrupted files, or any other similar software or programs that may damage the operation of anyone’s computer or property or adversely affect the quality, performance or functionality of the Web site.
Advertise or offer to sell or buy any goods or services for any business purpose, unless such services specifically allow such messages.
Inhibit or restrict any other user from using and enjoying the Web site.
Delete or falsify any copyright information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.
Download any file posted by another user that you know, or reasonably should know, may not be legally reproduced, displayed, performed, or distributed in such manner.
Violate any code of conduct or other guidelines which may apply to any particular service.
Collect information about others, including e-mail addresses.
Violate any applicable laws or regulations, including without limitation regulations promulgated by the Ministry of Transport Malaysia.

Ministry of Transport Malaysia is not required to monitor the Web site. However, Ministry of Transport Malaysia reserves the right to review and remove materials posted to the Web site in its sole discretion.

In its sole discretion, Ministry of Transport Malaysia may disclose any information it deems necessary or appropriate to satisfy any applicable law, regulation, legal process or governmental request, or refuse to post, remove or edit any materials, in whole or in part.

5. PHOTO SUBMISSION TERMS OF USE

By uploading, posting, sending or submitting photographs, pictures, images or any other content including without limitation, graphics, video, data, text, files, links, software, music, sound, ("content") to PanduCermat.org.my you are consenting to be bound by Ministry of Transport Malaysia's photo submission terms of use. If you do not agree, do not upload, post, send or submit any content to PanduCermat.org.my.

The Ministry of Transport Malaysia claims no ownership rights in any images or photographs submitted to the Web Site. You acknowledge that Ministry of Transport Malaysia has no control over the use of your images or photographs and shall not be held liable for any use, publication or copying of your images and photographs. You waive all rights of action or other claims you may have against us in respect of any such use, publication or copying.

You are hereby advised that any image or photograph submitted by you to the Web site is subject to our review.

Ministry of Transport Malaysia reserve the right at their sole and absolute discretion to refuse to display and to remove images or photographs from the Web site deemed to be objectionable by Ministry of Transport Malaysia or considered by Ministry of Transport Malaysia contrary to applicable laws.

Any perceived violations of laws including laws relating to child pornography, child abuse and animal abuse will be reported to law enforcement authorities if in the Ministry of Transport Malaysia's sole judgment such images are in violation of applicable laws.

Without limiting the above in any way, you are not permitted to post, upload, email or transmit or request the uploading by any store to the Website any image or photograph the content of which:-

is, or the Ministry of Transport Malaysia believes is offensive, personally offensive, defamatory, abusive, obscene, upsetting, menacing, threatening, harassing, pornographic, of an adult or sexual nature or, in any way unsuitable for persons under the age of 18 years;
is illegal under any law or regulation at any place where images or photographs are posted or uploaded from and / or viewed, and / or received, or infringes any industry code of conduct;
is copyrighted content or material that is used without the express permission of the owner or which infringes the intellectual property rights of any person;
in the Ministry of Transport Malaysia's opinion reflects badly on the Web site.
